This U.S. and Rest of World Privacy Supplement includes additional information and disclosures we are required to provide to individuals located in those jurisdictions. It is part of and incorporated into the Privacy Policy. You should read them both carefully.
For simplicity, terms used here have the same definitions as in our Privacy Policy unless otherwise noted below.
While this U.S. and Rest of World Privacy Supplement refers to information required by the California Consumer Privacy Act, as amended by the California Privacy Rights Act (the “CCPA”), we offer these privacy disclosures and rights to all Students, Instructors, Administrators and other consumers who are not covered by the other jurisdiction-specific privacy supplements.
Personal Information Respondus Processes

Video Data
Our Services may include videos, and we may Process your viewing data to better understand our audience, market our Services, and provide you with personalized recommendations and other features. This data may include information about the videos you have watched, the time and date of viewing, and other similar information. We disclose this data to third parties, including the service providers that assist us with providing those videos and related services to you.
We Do Not Sell or Share Your Personal Information
You have the right to know whether your Personal Information is being sold or shared.
Respondus does not sell or share your Personal Information, as those terms are defined under the CCPA. In the preceding twelve months, we have not sold or shared any Personal Information of consumers.
Your Privacy Rights
Subject to certain requirements and exceptions, you have the following rights:

The exact scope of these rights may vary by location. As additional jurisdictions enact additional rights on behalf of their residents, we will comply with such laws to the extent it is applicable to our activities. This U.S. and Rest of World Privacy Supplement is not intended to be an exhaustive list of all such rights now or in the future.
Also, Respondus generally does not Process Personal Information for profiling or automated decision making. However, the Respondus Monitor Privacy Policy Supplement describes how some laws may treat Processing performed by Respondus Monitor as such. Please review it for more information.
Exercising Your Rights
As described in our Privacy Policy, if you are using Respondus’s Services, including our Software, through an Institution, then that Institution is the controller of your Personal Information, and Respondus Processes that Personal Information on behalf of the Institution. You should contact your Institution directly to exercise your rights. Respondus will send all requests regarding Student Personal Information to the respective Institution.
If you are independently using Respondus’s Services, to exercise your rights, you may contact us through our Privacy Contact in writing. Please be aware that we do not accept or process requests through other means (e.g., via fax, chats, social media etc.).
In accordance with applicable laws, when you make a request, we may ask you to provide verifying information, and we will not fulfill your request unless you have provided sufficient information for us to reasonably verify you are the consumer about whom we collected the Personal Information. You may designate an authorized agent to submit a request on your behalf, subject to proof of identity and written authorization as required under the applicable privacy law. As part of our verification process, we may request that the agent provide, as applicable, proof concerning his or her status as an authorized agent. In addition, we may require that you verify your identity as described above or confirm that you provided the agent permission to submit the request.
You may appeal our decision regarding a request within a reasonable period after you have received our response to your request. You may file an appeal by contacting us through the same channels as to exercise your rights.
We will not discriminate against you because you exercise these rights, but ending the Processing of or deleting information may result in us being unable to Provide certain Services to you.
Other California Privacy Rights
Respondus does not make any disclosures of Personal Information to other organizations for their direct marketing purposes, but California’s “Shine the Light” law permits users of our Website that are California residents to request information about such disclosures, if applicable.
